Delhi: The Supreme Court Registry has reportedly rejected the Centre’s request to modify its 2012 ruling in the 2G spectrum case, which stated that the government was obligated to use auctioning as the method of transferring or disposing of natural resources.
According to sources, the registry deemed the plea as “misconceived” and an attempt to review the judgement under the guise of seeking clarification. As per the Supreme Court Rules, the Centre has the option to appeal against this decision.
The 2012 verdict had cancelled 2G spectrum licenses issued during A Raja’s tenure as telecom minister and on April 22, the Attorney General had urgently requested for a listing of the application seeking modification. The Centre has asked for an exemption from auctioning spectrum for non-commercial purposes if it is in line with governmental functions or public interest, citing technical constraints.
